These Terms of Service (the “Terms”) govern your use of status302: the website and developer documentation at status302.com, the web app at app.status302.com, the API at api.status302.com, and the realtime stream, webhooks, exports and SDKs that come with them (together, the “Service”). Please read them before you create an account. By creating an account, starting a subscription or using the API, you accept these Terms.
These Terms are also the terms and conditions (regulamin) for providing services by electronic means within the meaning of the Polish Act of 18 July 2002 on Providing Services by Electronic Means. How we handle personal data is described in our Privacy Policy.
1. Who we are
The Service is provided by status403 Sp. z o.o. (status403 Spółka z ograniczoną odpowiedzialnością), with its registered office in Warsaw, Aleja "Solidarności" 68 lok. 121, 00-240 Warszawa, Poland, entered in the Register of Entrepreneurs of the National Court Register (KRS) kept by the District Court for the Capital City of Warsaw, 12th Commercial Division, under KRS number 0001269943, NIP 5253108931, REGON 54585207200000 (“we”, “us”).
You can reach us at [email protected], or by post at the address above.
2. Definitions
- Account — your personal user account in the Service, identified by your email address.
- Organisation — a workspace in the Service that holds a subscription, its members, API keys, lists, alert rules and other settings. Every account has a personal organisation; you can also create or join team organisations.
- Customer — the business that holds an Organisation’s subscription; you means the Customer and each person using the Service under its Organisation, as the context requires.
- Plan — the subscription tier of an Organisation, with the features and limits described on the pricing page and in the docs.
- Market Data — the event, inventory, listing, price, sales and seat-map data, and the analytics derived from it, that the Service makes available.
- Your Content — what you put into the Service: lists, alert rules, notification channels, webhook endpoints, presets, names and similar settings.
3. Who may use the Service
The Service is designed for businesses: ticket brokers and the teams and developers who build on ticket market data. You may use it only if you are at least 18 years old and use it for purposes connected with your business or profession. If you accept these Terms on behalf of a company or other organisation, you confirm that you are authorised to bind it, and “you” includes that organisation.
If, despite this, you use the Service as a consumer — or as a sole trader for whom, under Polish law, the contract is not of a professional nature — nothing in these Terms limits the rights mandatory law gives you. In particular, the limitations in sections 8, 13 and 14 apply to you only to the extent the law allows.
4. Accounts and Organisations
- Signing up. You sign in with a link sent to your email address, or with your Google or Discord account. Give us an email address you control, and keep access to it secure: anyone who can read it can sign in as you. We recommend enabling two-factor authentication.
- Your responsibility. You are responsible for what happens under your Account and, as an owner or admin, for the members, roles, API keys and settings of your Organisation. Tell us at once at [email protected] if you suspect unauthorised access.
- Members and roles. An Organisation’s owners and admins can invite members, change their roles and remove them. Each member has their own Account; accounts must not be shared between people.
- Accurate information. Keep the information in your Account and your billing details accurate and up to date.
5. Plans, trial and payment
- Plans and prices. The Plans, their features and limits are described on the pricing page. Prices are per seat and are shown at checkout before you pay. Every member of an Organisation is a seat on its Plan. Unless checkout states otherwise, prices do not include VAT or other taxes, which are charged in addition where applicable.
- Free trial. An Organisation’s first subscription starts with a free trial of the length shown at checkout (currently 14 days). You provide a payment method at checkout; the first payment is taken when the trial ends unless you cancel before then.
- Billing. Subscriptions are paid in advance for each billing period shown at checkout and renew automatically until cancelled. Payments are processed by Stripe; you authorise us, through Stripe, to charge your payment method for each period. When members join or leave an Organisation, the number of seats is adjusted and the difference is prorated.
- Changes and cancellation. You can change Plan or cancel at any time in Settings → Billing. Plan changes are prorated, as shown before you confirm them. A cancellation takes effect at the end of the paid period, and the Organisation keeps its Plan until then. Except where the law requires otherwise, fees already paid are not refunded, including for a partly used period.
- Late payment. If a payment fails, Stripe retries it and the Organisation keeps its Plan while it does. If payment is not made, the subscription ends and the Organisation falls back to the free tier, which has no paid features. Your Account and Your Content are kept, so you can subscribe again.
- Enterprise. Enterprise Plans are agreed individually. Where an Enterprise order includes a daily API volume, requests above it are billed as overage at the agreed rate; requests we refuse with a rate-limit (429) or server (5xx) error are never billed. If an individual agreement conflicts with these Terms, the agreement prevails.
- Price changes. We may change the price of a Plan for future billing periods. We will tell the Organisation’s owners at least 30 days in advance; if you do not agree, you can cancel before the new price applies.
6. The API
- Keys. API access requires an API key created in your Organisation, on a Plan that includes the API. Keys belong to the Organisation that created them. Keep them secret: do not share them outside your Organisation, do not put them in code that runs in a browser or ships to others, and rotate or revoke a key you believe is exposed. You are responsible for all requests made with your keys.
- Quotas and rate limits. Each Plan has request quotas, stream connection limits and other limits, described in the docs. Requests above them are refused. Do not try to get around them, for example by spreading traffic over several Organisations or keys.
- Changes to the API. We develop the API in a backwards-compatible way where we can. We announce deprecations in the API changelog and give at least 6 months’ notice before removing an operation, unless a change is required by law, by a security issue or by a change in a data source outside our control.
7. Market Data and your licence to use it
- Where it comes from. Market Data is collected automatically from third-party sources, including official APIs and publicly available information on ticket marketplaces, and is processed and enriched by us. Some of it is estimated: for example, sales are inferred from changes in listed inventory, and are labelled with a confidence level.
- Your licence. While your Organisation’s subscription is active, we grant the Customer a non-exclusive, non-transferable licence to access and use Market Data, through the features of its Plan, for its own internal business purposes — including to inform its buying, pricing and selling decisions and to power its own internal tools. Exports and API responses may be stored and used for the same purposes.
- What the licence does not allow. You may not sell, sublicense, publish or otherwise make Market Data available to third parties as data — for example by reselling it, offering it through your own API or product, or giving access to people outside your Organisation — or use it to build a product or service that competes with the Service, unless we have agreed to it in writing. Aggregated insights that do not reproduce Market Data in substance, such as your own reports and decisions, are yours.
- No affiliation. We are not affiliated with, endorsed by or sponsored by Ticketmaster, StubHub, viagogo or any other marketplace, venue or event organiser whose data appears in the Service. Their names and trademarks belong to their owners and are used only to identify the source and subject of the data.
8. Accuracy of Market Data
Market Data comes from sources we do not control and may be delayed, incomplete or inaccurate, and estimates may differ from what actually happened. Sources may change, limit or stop access to their data without notice, which may affect what the Service can show. The Service is an information tool: it is not financial, investment or legal advice, and you remain solely responsible for your decisions and for checking information that matters to you before relying on it. To the extent the law allows, we give no warranty that Market Data is accurate, complete or fit for any particular purpose.
9. Acceptable use
When using the Service you must comply with the law, including the laws that apply to the purchase and resale of tickets where you operate. You must not:
- provide or store content that is unlawful, infringes the rights of others or is harmful, including in names, lists, alert rules and messages;
- access the Service other than through the web app, the API and the documented integrations — for example by scraping the web app or automating it with scripts — or try to access data or accounts you are not entitled to;
- interfere with the Service or its security, probe or test it for vulnerabilities without our written permission, or send malware or excessive traffic;
- get around Plan limits, quotas, access controls or billing;
- copy, modify or create derivative works of the Service’s software, or decompile or reverse engineer it, except where the law expressly permits it;
- resell, rent or share access to the Service, or use it on behalf of third parties, except as part of your own Organisation’s business;
- use the Service in a way that breaches these Terms or harms us, other users or third parties.
If you find a security issue, please report it to [email protected].
10. Your Content
You keep all rights to Your Content. You grant us the rights needed to host, process and transmit it to provide the Service to you — for example, to evaluate your alert rules and send notifications to the channels and webhook endpoints you set up. You are responsible for Your Content and for having the right to use the destinations you configure. We do not use Your Content for any other purpose.
11. The Service, its availability and changes
- Ownership. The Service, its software, design, documentation and the database of Market Data as compiled by us are protected by law and belong to us or our licensors. Except for the licence in section 7, these Terms grant you no rights in them. If you send us feedback or suggestions, we may use them without obligation to you.
- Availability. We work to keep the Service available and secure, but we do not guarantee uninterrupted or error-free operation unless we have agreed a service level in writing. We may interrupt the Service for maintenance, preferably at times of low use, and for security reasons.
- Changes. We continuously develop the Service and may add, change or remove features. If we remove a feature that is a material part of your paid Plan, we will tell you in advance, and you may cancel and receive a pro rata refund of fees paid for the period after the change.
- Third-party services. Some features rely on services run by others — Stripe for payments, Google and Discord for sign-in, and the messaging services you choose for notifications. Their own terms apply to your use of them, and we are not responsible for them.
12. Technical requirements and risks
To use the web app you need a device connected to the internet, an email address and a current version of Chrome, Edge, Firefox or Safari with JavaScript and cookies enabled. To use the API you need an HTTP client that supports HTTPS. Using services over the internet carries risks, such as malware, phishing and interception of data on insecure devices or networks. Keep your devices and software up to date, open sign-in links only from emails you requested, and never share sign-in links, recovery codes or API keys. We will never ask you for them.
13. Liability
- Business customers. To the extent the law allows: (a) we are liable only for damage we have caused through our fault, and not for lost profits, lost revenue, lost data or indirect damage; and (b) our total liability arising out of or in connection with the Service and these Terms is limited to the fees the Customer paid us for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability for damage caused intentionally or any other liability that cannot be limited by law.
- Consumers. If you use the Service as a consumer, our liability is governed by the provisions of law that protect consumers, and the limitations above apply only to the extent those provisions allow.
- Your responsibility. If you are a business, you will compensate us for damage and reasonable costs, including legal costs, arising from claims by third parties caused by your breach of these Terms or by Your Content.
14. Suspension and termination
- By you. You can stop using the Service at any time. Cancelling a subscription is described in section 5. To delete your Account, or a team Organisation you own, write to [email protected] from the address your Account uses; we delete it as described in the Privacy Policy. An Organisation with an active subscription is deleted once the subscription has been cancelled.
- By us. We may suspend access, or terminate an Account or Organisation, if you materially breach these Terms, if payment is not made, if your use endangers the security or operation of the Service, or if the law requires it. Where reasonable, we will tell you first and give you the chance to fix the problem. We may also terminate the Service for everyone, or a free account, with at least 30 days’ notice, refunding any fees paid for the period after the end of the Service.
- Effect. When access ends, your licence to Market Data ends and you must stop using the Service. Export anything you need before then. Sections that by their nature should survive termination — including 7.3, 8, 13 and 16 — continue to apply.
15. Complaints
You can submit a complaint about the Service by email to [email protected] or by post to our registered office. Please describe the problem and include the email address of your Account, so we can find it. We will respond within 14 days of receiving the complaint, by email unless you ask otherwise.
16. Governing law and disputes
These Terms are governed by Polish law. Disputes with business customers are settled by the common court having jurisdiction over our registered office. If you are a consumer, you keep the protection of the mandatory provisions of the law of the country where you live, and may bring a claim before the courts that the law makes competent for you; you may also use out-of-court complaint and redress procedures, such as the help of a municipal or district consumer ombudsman.
17. Changes to these Terms
We may change these Terms for important reasons, such as changes to the Service, to the law or to the requirements of authorities, or to improve security. We will tell account holders about changes by email or in the app at least 14 days before they take effect, unless the change is required sooner by law. If you do not accept a change, you may cancel and stop using the Service before it takes effect; continuing to use the Service after that date means you accept the new Terms. The date of the last update is shown at the top of this page.
18. Final provisions
These Terms, together with the Privacy Policy and any individual agreement with us, are the whole agreement between you and us about the Service. If any provision is found invalid, the rest remain in force. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights or obligations under these Terms without our consent; we may transfer them to a successor of our business. These Terms are drawn up in English.
